Confidentiality & Participation Agreement

By agreeing to test the mA.I Health app (the "App"), you ("Tester") agree to the following terms:

  1. Confidentiality

    • You agree to keep all information about the App strictly confidential, including but not limited to its features, interface, performance, functionality, and any technical or design aspects.
    • You may not copy, disclose, discuss, or share screenshots, descriptions or details of the App with any third party, including on social media, forums or blogs.
    • You may only discuss the App with the development team or your healthcare provider, for the purpose of reviewing your personal health data.
  2. Permitted Use

    • You agree to use the App solely for the purposes of testing and providing feedback.
    • You may share your health data stored in the App with your medical provider for the purpose of obtaining medical advice or treatment. Such disclosures must be limited to the minimum necessary information required.
    • You will not attempt to reverse-engineer, decompile, or access any unauthorised part of the App.
  3. Data Protection & Privacy

    • The App is designed to be HIPAA, GDPR, and New Zealand Privacy Act 2020 compliant.
    • You consent to the collection and processing of your personal and health information in accordance with the App’s Privacy Policy (attached or linked). Data Processing under GDPR and NZ law includes collection and storage of health data. The App does not process your health data in any other way.
    • The App may request access to your device camera. Camera access is used solely for scanning health-related documents that you choose to upload. These images are securely transmitted to our servers for recognition and are never used for any purpose other than providing the core functionality of the App.
    • Any data you input is securely stored, encrypted in transit and at rest, and not shared with third parties unless expressly authorised or actioned by you or as required by law.
    • Your data will not be shared with third parties, except as necessary for app functionality (e.g., cloud storage providers under Business Associate Agreements).
  4. Your Rights

    • You have the right to access, correct, or request deletion of your personal information. You may also withdraw consent for data processing at any time by contacting us at susan.green@maihealth.app. For more details, see our Privacy Policy attached.
  5. Security Acknowledgement

    • You acknowledge that the App incorporates reasonable and appropriate technical and organisational safeguards to protect your data.
    • While all efforts have been made to ensure security and compliance, as a beta product, the App is still undergoing testing and development. mA.I Health is not liable for any damages arising from your use of the App during beta testing, except as required by law.
  6. No Medical Advice

    • The App is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with your healthcare provider regarding any medical condition or health concerns.
  7. Feedback

    • You agree to provide constructive feedback, including bug reports and usability suggestions. Feedback may be used to improve the App, and you waive any rights to compensation or intellectual property in relation to your suggestions.
  8. Voluntary Participation & Termination

    • Participation is voluntary and may be terminated by either party at any time. Upon termination, you agree to delete the App and all related content from your device(s).
  9. Breach Notification

    • In the unlikely event of a data breach, we will notify you promptly, as required by GDPR (within 72 hours where feasible) and New Zealand’s Privacy Act 2020.
  10. Governing Law

    • This Agreement is governed by the laws of New Zealand. Any disputes arising under this Agreement will be subject to the exclusive jurisdiction of the courts of New Zealand.
